These Terms of Service (“Terms”) govern your use of the website www.misterrhino.org (“Website”) and the subscription-based design services provided by Mister Rhino (“we”, “us”, “our”). By accessing our Website or subscribing to our services, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our Website and services.

Scope of Services
Mister Rhino provides subscription-based design support to businesses, including but not limited to: • Branding & identity development • Graphic design • UI/UX design • Presentation design (PowerPoints, pitch decks, investor decks) • SEO optimization and website content structure • Marketing collateral design • Digital content creation • Content guidelines & brand strategy • Misc. design-related tasks as agreed Service availability depends on the selected subscription tier: 2.1 Full-Time Subscription Package Includes: • Priority support • Unlimited design requests (one active task at a time unless otherwise negotiated) • Full-time availability during defined business hours • Faster turnaround times 2.2 Part-Time Subscription Package Includes: • Limited daily design hours • Unlimited design requests (completed sequentially) • Standard turnaround times Design deliverables depend on request complexity and current workload within the scope of your plan.
Subscription, Payment & Billing
3.1 Subscription Terms Subscriptions renew automatically every month unless canceled in accordance with Section 3.3. 3.2 Payment • Payment is due upfront for each billing cycle. • Payment methods accepted will be displayed on the payment page. • Invoices are issued in accordance with German tax law. 3.3 Cancellation • You may cancel at any time. • Service remains active until the end of the current billing period. • No partial refunds are offered for unused days or unused design hours. 3.4 Late or Failed Payments • Access to services may be suspended until payment is completed. • Late payments may incur delays in project timelines.
Client Responsibilities
By subscribing to Mister Rhino, you agree to: • Provide accurate and complete details for tasks • Supply brand guidelines, assets, or required materials • Respond to feedback and clarification requests • Respect intellectual property rights and licensing requirements • Not use the service for unlawful or harmful content If a request violates our ethical or legal standards, we reserve the right to reject it.
Intellectual Property Rights
5.1 Ownership of Deliverables Upon full payment for the subscription period: • All final delivered design materials become the property of the client. • We retain ownership of drafts, source files, and unused concepts unless agreed otherwise. 5.2 Licensing • You receive a worldwide, royalty-free, non-exclusive license to use the delivered materials for commercial and personal purposes. • Third-party assets (e.g., stock images, fonts, templates) are subject to their respective licenses. 5.3 Portfolio Use We may display completed work in our portfolio, website, or marketing materials unless you request otherwise in writing. A confidentiality agreement can be signed upon request.
Service Limitations
Mister Rhino is not responsible for: • Printing errors caused by third-party printers • Delays due to incomplete instructions or missing materials • Issues caused by third-party platforms (Calendly, hosting, CMS, etc.) • Legal compliance of client-provided content (e.g., copyrighted materials, trademark usage) We do not provide: • 3D modeling • Advanced video editing • Website development (beyond structural design & SEO consultation) • Legal consultations • Copywriting (unless agreed separately)
Availability & Turnaround Times
• Standard business hours: Monday–Friday, 10:00–18:00 CET (Berlin time) • Weekends or holidays may not be covered unless agreed separately • Turnaround times vary based on complexity, revisions, and workload
Confidentiality
We treat all client materials as confidential and do not share them with third parties except: • Service-related subcontractors • Cloud storage or file delivery platforms • Legal obligations (e.g., tax authorities) A separate NDA can be signed upon request.
Limitation of Liability
To the maximum extent permitted by law, Mister Rhino shall not be liable for: • Indirect, incidental, or consequential damages • Loss of profits, business, or data • Delays caused by third-party platforms • Issues arising from assets you provide (e.g., copyright violations) Total liability shall not exceed the amount paid during the current billing period. Nothing in this section limits liability arising from: • Intentional misconduct • Gross negligence • Mandatory consumer rights under German law
Data Protection
We process personal data according to: • EU GDPR • Germany's Bundesdatenschutzgesetz (BDSG) Please refer to our Privacy Policy for detailed information.
Termination by Service Provider
We reserve the right to terminate or suspend services immediately if: • Payment is not received • The client engages in abusive or unlawful behavior • Requests involve illegal, unethical, or harmful activities Upon termination, you keep all completed deliverables.
Dispute Resolution
• German law applies to these Terms • The place of jurisdiction is Berlin, Germany • Informal resolution is encouraged before legal action
Changes to These Terms
We may update these Terms to reflect legal, service, or operational changes. The updated version will be posted with a new revision date. Continued use of the Website constitutes acceptance of revised Terms.
